Terms of Service

1. Acceptance of Terms

By accessing or using Revcaster (“the Service”) operated by Revcaster (“we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all these Terms, do not use the Service.

These Terms apply to all users, including users on the free trial plan. Your continued use of the Service after any changes to these Terms constitutes acceptance of the revised Terms.

2. Description of Service

Revcaster provides AI-powered sales forecasting tools that allow users to upload sales data (in CSV format or via integrations) and receive time-series forecasts using proprietary machine learning models. Additional features include AI-generated insights, PDF report generation, anomaly detection, and scenario planning.

The Service is provided on a subscription basis (monthly) or with a limited free trial. Feature availability depends on your subscription plan.

3. Account Responsibilities

• Security: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@revcaster.co if you suspect unauthorized access.
• No sharing: Accounts are for individual use only. You may not share your account credentials with others or allow multiple users to access the service through a single account.
• Accurate information: You must provide accurate and complete information when registering. Impersonating another person or entity is prohibited.
• Age: You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

4. Acceptable Use

You agree not to:

• Upload malicious files, malware, or files containing executable code.
• Attempt to reverse engineer, decompile, or extract source code from the Service.
• Abuse the free trial by creating multiple accounts to circumvent usage limits.
• Use the Service for any unlawful purpose or in violation of any applicable regulations.
• Attempt to gain unauthorized access to other users' accounts or to our backend infrastructure.
• Use automated scripts to make requests beyond your plan's API limits.
• Resell or sublicense access to the Service without written consent.

We reserve the right to suspend or terminate accounts that violate these acceptable use policies without prior notice.

5. Payment Terms

• Billing cycle: Paid subscriptions are billed monthly in advance via Stripe. Your billing date is set when you first subscribe.
• No refunds for partial months: We do not offer refunds or credits for partial months of service. If you cancel, you retain access until the end of your current billing period.
• Plan downgrades: If you downgrade your plan, the change takes effect at the start of your next billing period. Your current plan's features remain active until then.
• Failed payments: If a payment fails, we will retry according to Stripe's retry schedule. After repeated failures, your account may be downgraded to the trial tier.
• Price changes: We will notify you at least 30 days in advance of any price changes via the email address on your account.
• Taxes: Prices are exclusive of applicable taxes. You are responsible for any sales tax, VAT, or other taxes applicable in your jurisdiction.

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Key data handling practices:

• CSV files you upload are automatically and permanently deleted after 24 hours. We do not store the raw content of your CSV files in our database.
• Forecast results (aggregated statistics) are retained while your account is active.
• You own all data you upload. By uploading, you grant us a limited, non-exclusive license to process your data solely to provide the Service.

7. Disclaimers

• Estimates only: Forecasts produced by the Service are statistical estimates based on historical data provided by you. They are not guarantees of future performance.
• No business advice: We are not responsible for any business decisions made based on our forecasts. Always consult qualified professionals for critical business decisions.
• “As is” service: The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
• Uptime: We target 99.5% monthly uptime but do not guarantee uninterrupted availability. Planned maintenance windows are announced in advance.

8. Limitation of Liability

To the fullest extent permitted by law, Revcaster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

• By you: You may cancel your subscription at any time via the billing portal in your account settings. Account deletion can be requested via our data deletion form.
• By us: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.
• Upon termination, your right to use the Service ceases immediately. Forecast results and account data will be deleted within 30 days unless a longer retention period is required by law.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent in-app notification. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and applicable national law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts.
